תנאי שירות

1. אזור שיפוט

בעת שאתם עושים שימוש באתר ובמקרה בו התגלעה כל מחולקת אתם מסכימים להלן כי האמור לעיל נמצא תחת סמכות השיפוט הבלעדי של החוק הישראלי תוך שימוש במערכת בתי המשפט הישראליים בלבד במחוז תל אביב

2. השירות הינו פעיל בכל שעות היממה ובכל ימות השבוע, וניתן לעשות בו שימוש לרבות רכישת מוצרים בכל עת. עם זאת ייתכן והאתר יהיה מושבת עקב תקלות שאינן בשליטת livenza אשר עלולות להתרחש בכל עת ו/או עקב עבודות תחזוקה שונות ו/או מסיבות אחרות, ולמשתמש לא יהיו טענות נגד Livenza בשל כך.

3. תנאי שימוש אלה מהווים הסכם נפרד בין המשתמש לבין Livenza-il.com (להלן: "האתר"). מוסכם ומובהר כי Livenza לא תהיה אחראית כלפי המשתמש במקרה של הפרת תנאים אלה על ידי משתמש אחר, וכי במקרה של הפרה כלשהי על ידי משתמש אחר יוכל המשתמש לתבוע אך ורק את הצד המפר ולא תהיה לו כל תביעה, טענה ו/או דרישה כלשהי כלפי Livenza.

4. באתר מוצעים למכירה מוצרים שונים כפי שהינם מפורטים ומופיעים באתר. עם זאת האתר (להלן: Livenza-il.com) רשאי בכל עת להפסיק את מכירתם של מוצרים מסוימים וכן להוסיף מוצרים חדשים ו/או לשנות את מגוון המוצרים המוצעים למכירה באתר, הכל על פי שיקול דעתה הבלעדי ובלא מתן הודעה מוקדמת, ומבלי שלמשתמש יהיו טענות נגדה בשל שינוי כאמור לעיל.

5. לצד כל מוצר מופיע מחירו, כאשר המחיר כולל מס ערך מוסף (מע"מ) אלא אם צוין אחרת. עם זאת Livenza-il.com רשאית לשנות את מחירו של כל מוצר בכל עת ועל פי שיקול דעתה הבלעדי מבלי שלמשתמש יהיו טענות נגדה בשל כך. יובהר כי המועד הקובע לעניין מחיר המוצר הוא מועד אישור ההזמנה על ידי המזמין ולא מועד הוספתו לסל הקניות.

6. Livenza-il.com משתדלת לוודא כי כל הפרטים, התיאורים ותמונות המוצרים המופיעים באתר הינם נכונים. עם זאת, ייתכנו שגיאות בתום לב בכל הנוגע לתיאור או לתמונות המוצרים באתר, ומראה המוצר המופיע על הצג של מכשירכם עלול להיות שונה מהמראה בפועל עקב הבדלים הנובעים, בין השאר, מהגדרות התצוגה ואיכות המסך במכשירכם. יובהר כי תמונות המוצרים המופיעות באתר הינן לצרכי המחשה בלבד אלא אם צוין אחרת בדף המוצר ואינן מחייבות באופן כלשהו את האתר (Livenza-il.com).

7. מכיוון שמלאי המוצרים משתנה מעת לעת, ייתכן ומוצר אשר יוזמן לא יהיה זמין במלאי של Livenza-il.com בעת ההזמנה. על כן Livenza שומרת לעצמה את הזכות שלא לספק למזמין את המוצר כתוצאה מכך לאחר שתיצור עמו קשר תוך זמן סביר ותודיע לו על אי זמינות המוצר במלאי של Livenza, מבלי שתהיה לו כל טענה נגדה בשל כך, ותהא רשאית להציע לו מוצר חלופי הנמצא במלאי. היה והמזמין כבר חויב בשל הזמנת המוצר אשר אינו נמצא במלאי, תחזיר לו Livenza-il.com את כספו בגין הזמנת המוצר.

8. בלי לגרוע מהאמור בתנאי שימוש אלה ובכפוף להוראות הדין, Livenza-il.com שומרת לעצמה במקרים מסוימים את הזכות לבטל הזמנה שבוצעה ואושרה לרבות, אך לא רק, במידה ותימצא טעות בפרטי המוצר אשר נוגעים למאפייניו ומחירו כפי שהופיעו באתר וכן במידה ויתגלה כי הזמנת המוצר נעשתה תוך הפרת תנאי שימוש אלה ו/או תוך פגיעה בצדדים שלישיים. במקרה כאמור Livenza-il.com שומרת לעצמה את הזכות שלא לספק למזמין את המוצר כתוצאה מכך לאחר שתיצור עמו קשר תוך זמן סביר ותודיע לו על ביטול כאמור מבלי שתהיה לו כל טענה נגדה בשל כך. היה והמזמין כבר חויב בשל הזמנת המוצר, תחזיר לו Livenza-il.com את כספו בגין הזמנת המוצר.

9. מחירי המוצרים באתר אינם בהכרח זהים למחירי המוצרים שעשויים להופיע בכל מקום אחר לרבות, אך לא רק, בדף הפייסבוק של Livenza-il.com בכל מקרה המחירים המופיעים באתר הם המחירים הקובעים לגבי כל רכישה של מוצרים המבוצעת דרך האתר.

10. במידה ותהא טעות כלשהי באספקת המוצר, Livenza-il.com תוציא ללקוח את המוצר בהזמנה חדשה יחד עם פיצוי בהתאם להסכמתו של הלקוח. במידה והלקוח הסכים לפיצוי זה - זמני המשלוח יתחדשו בהתאם לפוליסת המשלוחים באתר וללקוח למשתמש יהיו טענות נגדה (נגד Livenza) בשל כך / תלונה כנגד Livenza-il.com

ביצוע הזמנות & תשלום, אספקת מוצרים ומשלוחים:

11. התשלום באתר יכול ויבוצע באמצעות כרטיס אשראי בכפוף לאישור חברת האשראי, או באמצעות שירות PayPal. יובהר כי Livenza-il.com רשאית לשנות את דרכי ו/או אמצעי התשלום ו/או את דרכי ביצוע ההזמנה בכל עת לפי שיקול דעתה הבלעדי ובלא מתן הודעה מוקדמת מבלי שלמשתמש יהיו טענות נגדה בשל כך.

יובהר כי ככל והמזמין יבחר באפשרות תשלום באמצעות PayPal, הרי ששירות תשלום זה מסופק על ידי צדדים שלישיים ואינו בשליטת Livenza-il.com. על כן Livenza-il.com לא תהיה אחראית בגין כל תקלה ו/או בעיה לרבות בעיות אבטחה בתשלום אשר ינבעו כתוצאה מתשלום בדרך זו כאמור לעיל.

12. זמני המשלוח עומדים על בין 13 ל-39 ימי עסקים מיום אישור ההזמנה. Livenza-il.com רשאית לשנות את זמני המשלוח מעת לעת על פי שיקול דעתה הבלעדי ובלא מתן הודעה מוקדמת מבלי שלמשתמש יהיו טענות נגדה בשל כך.

13. במידה ושיטת המשלוח אשר נבחרה היא "שליח עד הבית" ובשל תקלה טכנית המשלוח אינו סופק ע"י שליח אלא לנקודת חלוקה, לא יהיה ללקוח כל טענה / תלונה כלפי Livenza-il.com. דרמיינס תחזיר את הכסף אשר שולם לדמי משלוח עד הבית וכאן יגמר הסיפור מבחינת שני הצדדים.

14.בתקופת הקורונה משלוחים עשויים להתעכב ב-45 ימי עסקים נוספים.

15. כיום כל הזמנה לכתובת בישראל פטורה מדמי משלוח, אם כי Livenza-il.com שומרת לעצמה את הזכות לגבות בעתיד דמי המשלוח בעבור הזמנת מוצרים על פי שיקול דעתה הבלעדי ובלא מתן הודעה מוקדמת מבלי שלמשתמש יהיו טענות נגדה בשל כך.

16. מבלי לגרוע מהאמור להלן, יובהר כי שירות המשלוחים ניתן על ידי צד שלישי אשר אינו בשליטת Livenza-il.com ולא באחריותה. על כן Livenza-il.com לא תהא אחראית בגין כל נזק אשר ייגרם על ידי כל גורם אשר יספק את שירות השליחים כמפורט לעיל, לרבות נזק הנובע מרשלנות.

17. כיוון שמדובר בשירות שאיננו בשליטת Livenza-il.com ולא באחריותה, ייתכנו עיכובים במועד האספקה עקב סיבות שאינן תלויות Livenza ואינן בשליטתה לרבות, אך לא רק, כוח עליון, מצב בטחוני רגיש באזור המשלוח, מזג אוויר קיצוני, מפגעי טבע ( רעידת אדמה, שיטפון וכו' ), מפגעים אחרים ( כגון : שריפה, חסימות כבישים וכו' ), מפגעי מחלות והתפרציות וירוסים שונים ועיכובים הנובעים משביתות, ולמזמין לא יהיו טענות נגד Livenza-il.com בשל עיכוב כאמור. יובהר כי לא יהיה בעיכוב כאמור כדי לפטור את המזמין מחובתו לשלם בעבור הזמנתו . במקרים אלו ולאחר הערכת מצב מחודשת תספק Livenza-il.com תאריך מסירה חדש להספקת המשלוח למזמין.

18. יובהר כי במידה ובעת אספקת המוצרים המזמין לא יאותר על ידי השליח חרף תיאום מראש / המוצר לא יאסף מנקודת האיסוף אשר נשלחה בהודעת SMS / מספר הפלאפון שסופק לא היה נכון - המוצר לא יסופק למזמין, והמזמין יצטרך לתאם עם שירות הלקוחות מועד חלופי לאספקת המוצרים. היה והמזמין יתאם משלוח נוסף, יחויב המזמין בדמי משלוח בשנית בנוסף לדמי המשלוח אשר שולמו על ידו על אף שהמוצרים לא סופקו לו.

במידה שהמשלוח חוזר למחסן שלנו בארץ - לאחר 7 ימים, משלוח שלא יבוצע עליו הפצה חוזרת יוחזר לחברה בחו"ל והמזמין לא יהיה זכאי להחזר.

19. Livenza-il.com לא תהא אחראית בגין עיכובים שאינם בשליטתה ו/או מקורם במזמין, לרבות אך לא רק, קשיים ביצירת קשר עם המזמין. עיכוב כאמור לא ייחשב כהפרת התחייבויות Livenza-il.com לאספקת המוצר, ולא יהיה בעיכוב כאמור כדי לפטור את המזמין מחובתו לשלם בעבור הזמנתו.

20. פינקי אופרס עובדים למול מס' ספקים, לכן ייתכנו פיצול משלוחים וזאת על מנת להעניק לכם את המחיר הזול ביותר.

שינוי וביטול הזמנה, ביטול עסקה והחזרת מוצרים

21.1: מדיניות החזרת המוצרים וביטול העסקאות של Livenza-il.com הינה בכפוף להוראות הדין לרבות הוראות חוק הגנת הצרכן תשמ"א-1981, והמזמין רשאי לבטל את הזמנתו ו/או להחזיר את המוצרים שהגיעו אליו בכפוף להוראות שלהלן.

21.2: יובהר כבר עתה כי לא ניתן להחזיר מוצר אשר נעשה בו שימוש זולת מקרים בהם מדובר במוצר פגום, והכל בכפוף להוראות הדין לרבות חוק האחריות למוצרים פגומים, תש"ם-1980.

21.3: שינוי או ביטול הזמנה על ידי המזמין יתאפשרו בהתאם להוראות הדין ובהתאם לשיקול דעתה של Livenza-il.com ובכפוף להוראות שלהלן.

21.4: מזמין אשר מעוניין לבטל או לשנות את הזמנתו ייצור קשר עם Livenza-il.com אשר פרטיה מופיעים בתנאי שימוש אלה ויודיע על רצונו לבטל או לשנות את ההזמנה בהתאם לעניין בהקדם. ביטול כאמור יתאפשר במידה וההזמנה טרם יצאה למשלוח.

21.5: עם קבלת הודעה על ביטול ההזמנה תחזיר Livenza-il.com למזמין את כספו בגין ההזמנה, אולם תהא רשאית, לפי שיקול דעתה ובכפוף להוראות הדין, לגבות דמי ביטול בשיעור של עד 5% מערך ההזמנה או 100 ₪, לפי הנמוך מבין השניים ובנוסף את עמלות המשלוח.

21.6: מזמין אשר מעוניין לשנות את הזמנתו באופן של הוספת מוצרים חדשים ישלם בעדם את המחיר הנקוב במועד שינוי ההזמנה ולא את המחיר שננקב במועד ההזמנה הראשונה.

21.7: ביטול עסקה והחזרת מוצרים בגינה יכול וייעשו תוך תקופה של עד 14 יום ממועד קבלת ההזמנה. לצורך ביטול העסקה על המזמין ליצור קשר עם Livenza-il.com ולהודיע על רצונו לבטל את העסקה. לאחר קבלת הודעת הביטול של המזמין וככל וזו תיעשה במועד האמור, תתאם Livenza-il.com עם המזמין את דרך החזרת המוצר. יובהר כי באחריות המזמין לדאוג להחזרת המוצרים Livenza-il.com וכי החזרת המוצרים כאמור תיעשה על חשבון המזמין.

21.8: עם קבלת המוצרים שהוחזרו אצל Livenza-il.com ובכפוף לבדיקתה את מצב המוצרים בעת החזרתם ואישורה בנוגע לתקינותם, תחזיר Livenza למזמין את כספו בגין ההזמנה. Livenza-il.com תהא רשאית, לפי שיקול דעתה ובכפוף להוראות הדין, לגבות דמי ביטול בשיעור של עד 5% מערך ההזמנה או 100 ₪, לפי הנמוך מבין השניים, כאשר שיעור דמי הביטול כוללים את דמי המשלוח גם אם אלא לא נגבו. הוראות סעיף זה בעניין דמי ביטול לא יחולו על ביטול שנעשה מחמת פגם במוצר שהוזמן בהתאם להוראות חוק האחריות למוצרים פגומים, תש"ם-1980 ו/או אי התאמה בין תכונות המוצר כפי שמופיעות באתר לבין תכונות המוצר בפועל, שאז לא ייגבו דמי ביטול מהמזמין, זאת בכפוף לבדיקת Livenza את טענות המשתמש בדבר אי התאמה ו/או פגם, בהתאם לעניין.

21.9: Livenza-il.com מדגישה כי על המזמין לבדוק כי המוצרים אשר קיבל לידיו תואמים את פרטי ההזמנה כפי שזו נעשתה על ידו. ככל וישנה אי התאמה בין המוצרים שהוזמנו למוצרים שהתקבלו בפועל (למשל הכמות שהתקבלה אינה תואמת את הכמות שהוזמנה), על המזמין להודיע Livenza-il.com תוך יום עסקים אחד על אי התאמה כאמור. ככל והמזמין לא הודיע Livenza-il.com במועד האמור, יראו את המזמין כמי שאישר כי קיימת התאמה בין ההזמנה למשלוח ולמזמין לא יהיו טענות נגד Livenza-il.com בשל כך.

21.10: תנאי לקבלת החזר כספי הוא מסירת מספר המעקב שהתקבל אצל המשתמש במועד הזמנתו Livenza-il.com . ויודגש – ללא קבלת מספר מעקב זה לא ניתן יהיה לקבל החזר כספי בין ביטול העסקה, והכל בכפוף להוראות הדין.

כתב ויתור על אחריות; הגבלת האחריות

22.1: יובהר כי המוצרים המוצעים למכירה באתר אינם מיוצרים על ידי Livenza-il.com, ועל כן האחריות הבלעדית לכל המוצרים באתר ולגבי כל מידע או מצג שנעשה באתר בכל הנוגע למהות המוצרים לרבות, אך לא רק, שמות היצרנים, טיב המוצרים, תכונות המוצרים, תמונות המוצרים וכיו"ב חלה על היצרנים ו/או היבואנים ו/או המשווקים המורשים של המוצרים, על-פי החוקים והתקנות להגנת הצרכן ובהתאם לתנאי תעודות האחריות והשירות אשר צורפו לכל מוצר, אם צורפו.

***אנו לא מתחייבים או אחראים כי השימוש שלך בשירות שלנו (ראש דוש) יהיו ללא הפרעות, כשל בבטיחות, או נטולי שגיאות. אנו לא מתחייבים שהתוצאות העשויות להתקבל מהשימוש בשירות יהיו מדוייקות או אמינות.

אתם מסכימים כי מעת לעת אנו עשויים להסיר את השירות שלנו לתקופות בלתי מגובלות או לבטל את השירות בכל עת.

בנוסף, אתם מסכימים במפורש כי השימוש במוצרים על אחריותכם הבלעדית בלבד, השירות וכל המוצרים והשירותים המועברים אליך באמצעות השירות שלנו - כפי שהוא וכפי שניתן (AS IS & AS AVAILABLE) לשימושכם, ללא כל אחריות או תנאים מכל סוג שהוא, מפורש או משתמע, כולל כל האחריות המשתמעת או תנאי הסחר, איכות הסחורה, התאמה למטרה מסויימת, עמידות ועוד.

בשום מקרה Livenza-il.com, הדירקטורים, העובדים שלנו, נושאי המשרה שלנו, השלוחות, הסוכנים, הקבלנים, המתמחים, הספקים, נותני השירות או נותני הרשיון לא יהיו אחראים לכל פגיעה, אובדן, תביעה או כל נזק ישיר, עקיף, מקרי, ענישה, נזק מיוחד או נזק תוצאתי מכל סוג שהוא, כולל - ללא הגבלה, אבידת הכנסות, אובדן הכנסות, אובדן חיסכון, אובדן נתונים, עלויות החלפה או כל נזק דומה, בין אם המקרה נגרם מרשלנות שלכם / שלנו, אחריות קפדנית או אחרת, הנובעת משימושך בכל אחד מהשירותים או במוצרים כלשהם שנרכשו באמצעות השירותים שלנו, או מכל טענה אחרת הקשורה בדרך כלשהי לשימושך בשירות או במוצר כלשהו, כולל, אך לא רק, כל שגיאה או מחדל, כל תוכן, כל אובדן נזק מכל סוג שהוא שנגרם כתוצאה מהשימוש במוצרים שלנו.

22.2: Livenza-il.com לא תישא באחריות לכל נזק ו/או פגיעה ישירים ו/או עקיפים מכל סוג שהוא שייגרמו למזמין ו/או לצדדים שלישיים כתוצאה משימוש ומהסתמכות על התוכן המופיע באתר.

22.3: הנתונים והמידע המופיעים על גבי המוצרים ובאתר ניתן לעתים על ידי צדדים שלישיים לרבות, אך לא רק, יצרנים, ספקים ו/או יבואנים, ועל כן Livenza-il.com לא תישא בכל אחריות בנוגע לנתונים והמידע על המוצרים כאמור לעיל אשר כאמור אינם מיוצרים על ידה.

22.4: Livenza-il.com עושה כל מאמץ על מנת לוודא כי המידע על המוצרים המופיע באתר יתאים למוצר הנמכר. עם זאת לעתים ייתכנו טעויות בתום לב בנוגע לפרטים ולמידע על המוצרים כפי שאלה מופיעים באתר, ועל כן טרם צריכת המוצר יש לקרוא בעיון את פרטיו של כל מוצר. ככל ובתום לב סופק לכם מוצר אשר אינו תואם את תיאורו באתר, ביכולתכם ליצור קשר עם Livenza אשר תדאג לזיכוייכם בגובה מחיר המוצר שנרכש ותתאם את החזרתו של המ . לחלופין ניתן גם להחליף את המוצר במוצר אחר ולקבל זיכוי ו/או להוסיף סכום נוסף בהתאם להפרש בין המוצר שהתקבל למוצר החלופי.

22.5: Livenza-il.com אינה מתחייבת כי הקישורים המצויים באתר, ככל ואלו יופיעו, יהיו תקינים ו/או יובילו לאתר אינטרנט פעיל. הימצאותו של קישור לאתר מסוים באתר של Livenza-il.com אין משמעו כי תוכן האתר הינו מהימן ו/או מלא ו/או עדכני ול-Livenza-il.coml אין כל שליטה על תוכן כאמור, ועל כן Livneza לא תישא בכל אחריות בקשר לכך.

22.6: Livenza-il.com אינה אחראית לכל נזק שייגרם למזמין כתוצאה מרכישה באתר לרבות, אך לא רק, מקרים בהם הרכישה לרבות התשלום בגינה מתבצעת שלא בהסכמתו ו/או בידיעתו של המזמין ו/או הקלדה שגויה של כתובת למשלוח ההזמנה ו/או הקלדה שגויה של פרטי כרטיס אשראי; וכן מקרים של תקלה בתקשורת עקב מעשה ו/או מחדל של ספקי תקשורת.

22.7: Livenza-il.com אינה אחראית לכל נזק שייגרם למזמין ו/או לצדדים שלישיים כתוצאה משימוש במוצרים זולת מקרים בהם המוצר היה פגום עקב רשלנות של Livenza-il.com . במקרה זה גובה האחריות של Livenza-il.com יהא מוגבל ולא יעלה על גובה סכום המוצר הפגום שנרכש.

22.8: אין Livenza-il.com אחראית על תוכנן של מודעות פרסום או הצעות מסחריות של צדדים שלישיים אשר עשויים להופיע באתר. כל טענה, תביעה או דרישה מצד משתמש בגין הצעות, מוצרים או שירותים כאמור, קבלתם או תוצאותיהם יופנו על ידו במישרין אל הצד השלישי, שממנו קיבל את ההצעה או קנה את השירות, ולא תהיה לו בגינן כל תביעה או דרישה כלפי Livenza-il.com ו/או מ מטעמה.

22.9: ל-Livenza-il.com ישנם סוכנים המשווקים את המוצרים. יודגש כי פעילות המשווקים לרבות תכנים שהם מעלים נעשית על פי שיקול דעתם בלבד ול-Livenza-il.com אין כל שליטה על פעולותיהם ועל כן ל-Livenza לא תהיה כל אחריות בנוגע לכל פעילות של המשווקים כאמור.

22.10: במידה ואספקת המוצר תתעכב ע"י "דואר ישראל", מסיבות שאינן קשורות בחברה, כי אז החברה תסיר כל אחריות לזמן אספקת המוצר ומסירתו ללקוח, וללקוח לא תהיה כל טענה ו/או דרישה ו/או תביעה בשל האיחור באספקת המוצר. אנו מתחייבים לזמני הגעת המוצר בין 12-45 ימי עסקים מעת קבלת ההזמנה. (כמו שצויין למעלה, בתקופת הקורונה ייתכנו עיכובים נוספים של עד 45 ימי עסקים)

הסכם זה ייכנס לתוקף ביום בו יעשה המשתמש שימוש כלשהו באתר, ויימשך עד לסיום השימוש בשירות על ידי המשתמש.

Livenza-il.com רשאית בכל עת לסיים הסכם זה במקרים הבאים: (1) המשתמש הפר הוראה מהוראות הסכם זה (או פעל באופן אשר מוכיח בבירור כי הוא מתכוון לעשות זאת או כי אינו מסוגל לקיים את הוראות ההסכם); (2) Livenza-il.com תידרש לעשות כן על פי דין (למשל, כאשר מתן השירות הינו או יהא בלתי חוקי); (3) מתן השירות אינו כדאי עוד מבחינה כלכלית. במקרים כאמור Livenza-il.com תמסור למשתמש, ככל הניתן, הודעה סבירה מראש אודות סיום ההסכם.

23.1: Livenza-il.com תוכל לשנות תנאים אלה מעת לעת על פי שיקול דעתה הבלעדי. האחריות להתעדכן בשינויים כאמור מוטלת על המשתמש באמצעות כניסה לתנאי שימוש אלה מפעם לפעם. שימוש בשירות בכל עת כמוהו כהסכמה לתנאים המעודכנים והמתוקנים, כפי שהיו באותה עת.

23.2: Livenza-il.com שומרת לעצמה את הזכות לשנות או להפסיק את השירות או חלק ממנו באתר, ללא מתן הודעה מראש. במקרה של הפסקת השירות, Livenza-il.com לא תהא אחראית כלפי המשתמש או כלפי צד שלישי כלשהו בגין נזק או אובדן.

24. כללי, סמכות שיפוט והודעות

24.1: תנאי שימוש אלה לרבות מדיניות הפרטיות מהווים את כלל המוסכם בין הצדדים וגוברים על כל הסכם, הצעה או מצג שנעשו בעבר, בכתב או בעל פה, בנוגע לנושאו. אף שינוי, תיקון או ויתור על הוראה בהסכם זה, לא יהא תקף, אלא אם נעשה בכתב ונחתם או אושר אלקטרונית על ידי הצד שכלפיו ייטען שינוי, תיקון או ויתור כאמור.
